Description

Anti-discrimination law has become the predominant paradigm for law applying to the relationship between employers and employees in the United States (though not, it bears noting in all parts of the world). In many respects, anti-discrimination law not only defines but also limits the rights workers can claim in relation to their employment experience. Law students interested in many areas of U.S. employment, business, labor, and/or civil rights law therefore should acquire a firm grounding in the analytic bases of U.S. anti-discrimination law as it applies to workplace relations, That is what this course tries to provide.

Our investigation will proceed as follows. After a short introductory unit, we will examine the structure of and distinctions among various theories of discrimination, including disparate treatment and disparate impact discrimination. We then will focus on several specific substantive areas of employment discrimination law, including race, sex, sexual orientation, religion and national origin, age, and disability.
