INTERNATIONAL AND COMPARATIVE TRADEMARK LAW, LAW-646
Professor Farley Spring 2011
This course concerns the international system regulating the protection of trademark rights. It focuses on the principal international conventions in the field of trademarks. We will also look at select bilateral treaties. The course considers current problems such as jurisdictional issues raised by the Internet, new rights such as anti-dilution, harmonizing geographical indication protection, domain names and the protection of famous marks. We will briefly consider comparative trademark law in terms of the differences in the registration process and problems in priority of rights and pay particular attention to efforts toward harmonization.
There are no prerequisites for this course, although Trademark Law is preferable. There will be a take-home essay exam.
